An attorney for the Times Leader says Hazleton has no basis to appeal a court ruling regarding the test scores of police candidates.

The appeal stems from the newspaper’s January 2005 request to see scores of written exams taken by all city police candidates. The city provided the scores but did not connect them to names of candidates.

In March 2005, the Times Leader filed suit in Luzerne County Court of Common Pleas, contending the information should be available under the state’s public records law, but Judge Michael Conahan dismissed the suit in December.

The newspaper filed an appeal, and earlier this month a three-member panel of the state’s Commonwealth Court ruled that Conahan had erred and that the names and scores are public record.

The city’s attorney, Conrad Falvello, then filed a request to appeal the case to the state Supreme Court.

On Thursday, the newspaper’s attorney, Ralph Kates, filed a response to the appeal request.

In the response, Kates said Hazleton has “failed to demonstrate any basis” for an appeal and asks the Supreme Court to not consider hearing an appeal.

WILKES-BARRE – Luis Gamboa, 27, of Nanticoke, was sentenced Thursday to three to six years in state prison on drug charges.

Luzerne County Judge Joseph Augello sentenced Gamboa in four cases on charges of delivery of a controlled substance, possession with intent to deliver a controlled substance, and a firearms violation.

In one case, Plains Township police said Gamboa in January sold heroin to an undercover officer in a township parking lot.

WILKES-BARRE – Ted R. Landis, 45, of Scranton, pleaded guilty Thursday to robbing the Wal-Mart Supercenter in Wilkes-Barre Township of more than $12,000.

Township police said Landis, a former night manager at the store, entered the store after 4 a.m. May 26, entered the cash office, and robbed the office clerk of the money.

Luzerne County Judge Joseph Augello will sentence Landis on charges of robbery and criminal trespass Dec. 8.
